1. Scope and Provider
These Terms of Service govern the use of the Human-me platform, a marketplace that connects clients seeking personal services with independent service providers. By registering an account, you agree to these terms.
2. Platform Role and Disclaimer
Human-me acts solely as an intermediary platform. We facilitate the connection between clients and providers but are not a party to the service contracts between them.
- The service provider is independently and solely responsible for the quality, safety, legality, and execution of their services.
- Human-me does not employ, supervise, or control service providers. All providers are independent individuals acting on their own behalf.
- Human-me does not guarantee the accuracy of any provider's qualifications, reviews, or self-reported information.
- Any disputes regarding service quality, damages, injuries, or dissatisfaction must be resolved directly between the client and the provider. Human-me bears no liability for any harm, loss, or damage resulting from services arranged through the platform.
- Human-me does not collect, store, or process client payment card numbers or bank account details. All payments are handled directly between the parties (via QR bank transfer or cash) or through third-party payment processors (Stripe). The platform has no access to your financial account data.
3. Registration and Account
- You must be at least 13 years old to register. Users aged 13-17 may register as Young Helpers with parental/guardian consent (see Section 4).
- You must provide accurate and complete information, including your date of birth
- You are responsible for maintaining the security of your account credentials
- Each person may maintain one account, which can include both client and provider roles
- We reserve the right to suspend or delete accounts that violate these terms
4. Young Helpers (Minors aged 13-17)
In compliance with the German Youth Labour Protection Act (Jugendarbeitsschutzgesetz — JArbSchG), minors aged 13-17 may register as service providers ('Young Helpers') under the following conditions:
- Parental consent: A parent or legal guardian must confirm consent via email verification before the Young Helper account is activated.
- Age 13-14: Maximum 2 hours per day, light work only (e.g., dog walking, babysitting, errands, tutoring). Work is not permitted during school hours.
- Age 15-17: Maximum 8 hours per day, not during school hours. Wider range of permitted categories, but medical, heavy physical, and night work remain prohibited.
- Restricted categories: Young Helpers may only offer services in: Pet Care, Errands, light Household help, Childcare (babysitting, homework help), and Lessons & Skills. Health, Night Watch, heavy physical work, and other restricted categories are not available.
- Payment: All earnings are paid to the parent/guardian's IBAN account. Young Helpers cannot use Stripe Express or receive payments directly until they turn 18.
- Privacy: The exact age of Young Helpers is not displayed publicly. A 'Young Helper' badge is shown instead.
5. Services and Booking
Clients can book services directly from a provider's profile or post a request that providers can respond to with offers. A booking becomes binding when:
- Both parties agree on the service, time, and price
- Payment is authorized (for paid services)
6. Payments and Fees
Human-me offers several payment methods. The platform does not collect or store client card numbers or bank account details.
- QR Bank Transfer (SEPA): The platform generates a QR code containing the provider's IBAN and payment amount. The client scans the QR code with their banking app and transfers the funds directly to the provider's bank account. Human-me does not process, hold, or have access to these funds at any point.
- Cash: Cash payments are arranged directly between the client and provider. Human-me is not involved in cash transactions.
- Card payments (Stripe): When available, card payments are processed by Stripe, a certified PCI-compliant third-party payment processor. Human-me never sees or stores your card number. Stripe handles all financial data independently.
- All payment disputes are between the client, the provider, and (if applicable) the payment processor. Human-me is not responsible for failed, delayed, or disputed payments.
7. Cancellation and Refunds
Cancellation policies may vary by provider. In general:
- Cancellations made more than 24 hours before the appointment are free of charge
- Late cancellations or no-shows may result in charges according to the provider's cancellation policy
- If a provider cancels, any held payment will be released back to the client
8. Reviews and Ratings
After a completed service, both parties may leave a review. Reviews must be honest, factual, and respectful. We reserve the right to remove reviews that contain hate speech, personal attacks, or false information.
9. Right of Withdrawal (Widerrufsrecht)
As a consumer within the EU, you have the right to withdraw from a distance contract within 14 days without giving a reason. However, pursuant to BGB Section 356(4) No. 2, the right of withdrawal expires for service contracts if the service has been fully performed and the consumer has given prior express consent that the entrepreneur may begin performance before the withdrawal period has expired.
By booking and authorizing payment for a service, you expressly consent that the service may begin before the withdrawal period has expired. You acknowledge that you lose your right of withdrawal once the service has been fully performed.
10. Limitation of Liability
- Human-me is not liable for the quality, safety, or legality of services provided by independent service providers.
- Human-me is not liable for any damages, injuries, losses, or harm caused by a provider to a client or vice versa. All interactions and services are at the users' own risk.
- Human-me is not liable for any financial losses arising from payments made between users, including QR bank transfers, cash, or card payments.
- Our liability as a platform operator is limited to intent and gross negligence in the operation of the platform itself. This limitation does not apply to damages arising from injury to life, body, or health caused by Human-me's own negligence.
- By using this platform, you acknowledge that Human-me is a technology intermediary only and accept full responsibility for your interactions with other users.
11. Provider Obligations
- Providers must have the necessary qualifications and licenses for the services they offer
- Providers are responsible for their own tax obligations and social insurance
